These Terms of Service ("Terms") govern your access to and use of the Clarive website, including any content, functionality, and services offered on or through it (the "Services"). Clarive is powered by Shopify, which enables us to provide the Services to you.

Please read these Terms carefully before using the Services. By accessing or using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not access or use the Services.

1. Eligibility

By using the Services, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority and you have given consent for any minor dependents to use the Services.

Payment is processed securely through Shopify's payment infrastructure and/or third-party payment processors. We do not store your full payment card information on our servers.

5. Shipping

Shipping times and costs vary depending on your location and the shipping method selected at checkout. We are not responsible for delays caused by the shipping carrier, customs processing, or other circumstances outside our control. Risk of loss and title for items purchased pass to you upon our delivery to the shipping carrier.

6. Returns and Refunds

Returns are accepted within 30 days of delivery. We provide free return shipping, and eligible returns will be processed as either a refund to your original payment method or store credit, at your choice. Full details are available in our Return & Refund Policy.

7. Intellectual Property

All content on the Services, including text, graphics, logos, images, and software, is the property of Clarive or its licensors and is protected by applicable intellectual property laws. THE SERVICES AND ALL PRODUCTS ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, CLARIVE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES OR PRODUCTS PURCHASED THROUGH THE SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT(S) GIVING RISE TO THE CLAIM.

13. Indemnification

You agree to indemnify and hold Clarive, its owners, employees, and affiliates harmless from any claims, losses, liabilities, damages, costs, or expenses (including reasonable attorneys' fees) arising out of your use of the Services, your violation of these Terms, or your violation of any rights of a third party.

14. Dispute Resolution and Arbitration

You and Clarive agree that any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Services shall be resolved through binding arbitration, rather than in court, except that either party may bring an individual action in small claims court. The arbitration shall be conducted on an individual basis, and you agree to waive any right to participate in a class action lawsuit or class-wide arbitration.

This arbitration provision does not prevent you from bringing issues to the attention of federal, state, or local agencies, and such agencies can, if the law allows, seek relief against us on your behalf.

15. Governing Law

These Terms and any dispute arising out of or related to them shall be governed by the laws of the State of Texas, without regard to its conflict of law principles.
